Daniel Firestone Will

Daniel Firestone was my 5th great-grandfather. He was born in Lancaster County, Pennsylvania, to Johannes Feuerstein and Augusta Justina Maria Hildebrand. He married Anne “Nancy” Lang in Cocalico Twp, Pennsylvania, on August 5 1783; Rev. John Waldschmidt officiated.

Daniel and Nancy had four children: Samuel, George Washington, Rebecca, and Sarah “Sally”.  Rebecca married Christian Smith.  Daniel died in 1823 in Miami Twp, Logan County, Ohio. The executors of his will were his sons Samuel and George.

Daniel’s exact date of death is unknown.  Will written on December 30, 1822, and probated on March 24, 1823.  He probably died in March 1823.

I’ve transcribed the will to the best of my ability. Please note that I have corrected capitalization and spelling errors (such as deceased). To make it easier to read online I have added punctuation and paragraph breaks.


Transcription of will:

The last will and testament of Daniel Firestone late of the County of Logan, Township of Miami, and State of Ohio was deceased was brought into Court and the subscribing witnesses thereto appeared and after being duly sworn as the law requires deposes and says that the deceased at the time of executing said will was of sound mind and memory.

Whereupon it was ordered by the court that Letters of executorship [illegible] to Samuel Firestone and George Firestone Executors named in aid deceased’s will be granted to said executor on the entering whereupon said Executors took the oath required by law and said will was ordered by the court to be placed upon record.

Said will being in the words as follows:

In the name of God, Amen.

I, Daniel Firestone, one of the county of Logan, State of Ohio, am very sick and weak in body but in perfect mind and memory.

Taking in consideration for all men to die once therefore I recommend my soul into the hands of God who give it and my body to be buried in a decent Christian manner and as touching my worldly estate wherewith it hath pleased God to bless me with in this world.

First and foremost, I do will and bequeath unto my beloved wife Nancy Firestone the dwelling house where I now live in, all out houses, barn and stables, the stove and bed, which she may choose one cow, which she may choose with sixty acres of land the west end of the quarter, and my beloved wife Nancy is to have the one third of all what my [illegible] property will amount to after being appraised and sold at Public sale.

And I will and bequeath to my beloved son Samuel Firestone two hundred and sixty dollars already paid to him.

And I do will and bequeath unto my beloved daughter Rebekah two hundred and sixty dollars already paid to her.

And I will and bequeath unto my beloved son George Firestone one hundred acres of land the east end of the quarter sexion where I now lie on.

And I do will and bequeath unto my beloved daughter Sally twenty dollars to be paid to her as soon as it can be conveniently done.

And after the death of my beloved wife the land where she lives on shall be sold and the money shall be divided between my beloved sons Samuel and George Firestone and my daughter Rebekah.

Further it is my will that the lot which I hold in the town of Logan, Hawkin County, shall be sold and the money be divided between my beloved wife Nancy Samuel and George Firestone and my daughter Rebekah.

And I direct and ordain my beloved sons Samuel and George Firestone my true and lawful Executors and I will revoke and disannul all other wills and allow this and no other to be my true last will and testament. Therefore I set my hand and seal this 30th day of December 1822.
